Education Framework, Inc. (“EFI,” “us,” “our,” or “we”) is committed to the confidentiality and security of personal information provided to us through our website and online services (collectively, the “Services”).  This privacy policy applies to the use of our Services and describes how we protect information gathered from parents and students who use our Services, and student and other School-related information we access or gather on behalf of school districts (referred to as a “School” or “Schools”) that register for our Services.

  1. How EFI Collects and Uses Information.

Our Services include e-Forms and Compliance software that allows Schools to manage parental consents related to student access to third-party websites or other web-based services that Schools offer for the benefit of their students and the school system.  In connection with providing the Services, we collect information about Schools and their users.  The information we collect includes personally identifiable information (“Personal Information”).  We strive to collect only the information that is necessary to provide the Services.

When a School registers for our Services or corresponds with us online, we collect information about the School, such as the administrator managing the School’s account with us, teachers, and the information systems used by the School.  We use the information gathered or provided in order to provide our Services, maintain and improve the functionality of our Services, and to communicate with Schools (including administrators, teachers, and staff), parents, and students.  As used in this privacy policy, “parent” includes legal guardian.   

Schools that register for our Services provide us access to Personal Information about students, including information contained in the School’s Education Records.  “Education Records” is a defined term under the Family Educational and Privacy Rights Act (FERPA).  The definition can be found at 20 USC 1232g; 34 CFR 99 (for more information visit https://studentprivacy.ed.gov/faq/what-education-record).  Access to Personal Information about students is typically provided to us via the School’s information systems, which may be integrated with a third-party provider that also receives Personal Information about students from the School. Depending on the scope of Services that a School has registered for, we may provide access to our Services to Schools (including administrators and teachers), parents, and students using the user’s own login credentials. If you are a parent or a student and have questions about the School’s use of technology or approved websites or applications, please contact the School directly.  If a student contacts EFI, EFI will collect only enough information to respond to the inquiry and direct that inquiry to the appropriate School.  EFI may provide data to Schools, students, or parents through the Services about third-party websites or applications.  That information is provided at the School’s request.  EFI does not endorse, authorize, or approve the Schools’ use or access to technology products or services in Schools or by School personnel. 

If parents use our Services through the School’s account with us, we will collect information from the parent only as necessary to provide the Services to the parent on behalf of the School.  Schools may provide us access to Personal Information about parents contained in the School’s information systems. 

We treat all Personal Information, and all other information provided to us by the School and its users, as confidential and protect it as provided in this privacy policy.  

We will retain information that we access, gather or collect on behalf of Schools for as long as the School’s account is active or as needed to provide the Services. Please contact us if you wish to cancel your account or request that we no longer use your information to provide you Services.  Please remember that, even if you make a request, Schools may have authority to provide us ongoing access to certain Personal Information, including Education Records.  It is also important to remember that we are obligated by law to delete Personal Information upon the request of a School where such Personal Information is under the control of that School.  Schools’ authority arises under state and federal law.  If you have questions about your School’s information practices, please contact the School directly. 

We are continually working to enhance and improve our Services.  We may use De-identified Information (defined below) and other information provided to us by the School and its users in connection with supporting, maintaining, developing, troubleshooting and otherwise working to improve and enhance the Services.

We will also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Our Services will automatically gather some types of information when users visit or use our Services.  We also collect analytics data and use third-party analytics tools to help us measure traffic and usage trends for the Services and to diagnose or fix technical problems. These tools collect information sent by your browser or mobile device, including the web pages you visit, the files you viewed or transmitted, how you use the Services, the geographic location from which you access the Service, and other information that assists us in improving our Services.  We collect and use this analytics information in de-identified and aggregate form such that it cannot reasonably be manipulated to identify any particular individual user or visitor (“De-identified Information”). We may use De-identified Information to create reports on usage trends and efficiency metrics that may include the name of the School.  EFI does not allow any third-party advertisers to interact with its Services or collect information of any kind. 

We may use “cookies” (session ID or persistent) to store relevant user session information and user preferences.  We may use the information collected through cookies to make it easier for you to use or navigate within our Services.  A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.  EFI does not respond to “Do Not Track” browser signals.  If you reject cookies, you may still use our Services, but your ability to use certain features or functions may be limited.  We may employ clear gifs (also known as web beacons), which are used to anonymously track the online usage patterns of our users. We may also use clear gifs in HTML-based emails sent to our users to track which emails are opened and which links are clicked by recipients. The information allows for more accurate reporting and improvement of our Services and is only used for School related purposes or for enhancement and support of the Services.

The use of cookies by our partners, affiliates, tracking utility company, and service providers is not covered by our privacy statement. We do not have access or control over these cookies. Our partners, affiliates, tracking utility company, and service providers use session ID cookies to make it easier for you to navigate our site.

When you access our Service through a mobile device we may access, collect, monitor and/or remotely store one or more “device identifiers,” such as a universally unique identifier. Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by Education Framework. A device identifier may convey information to us about how you browse and use our Service. A device identifier may remain persistently on your device, to help you log in faster and enhance your navigation through the Service. Some features of our Service may not function properly if use or availability of device identifiers is impaired or disabled.  

  1. How EFI Shares Information.

We will never sell, rent, or exchange Personal Information we collect for marketing purposes or otherwise.

We may share information with third party vendors, hosting partners, and analytic companies to provide the necessary hardware, software, emailing, networking, storage, and related technology required to perform the Services. These companies are authorized to use your Personal Information only as necessary to provide these services to us.

We will share your Personal Information to the extent necessary to comply with a subpoena or similar legal process, when we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, to investigate fraud, or to respond to a government request, or with your consent. 

If we sell, dissolve, or merge our business, you will be notified via email of any choices you may have regarding your Personal Information.  We will endeavor to prohibit the transfer of Personal Information to another owner or business unless that new owner or business has adopted privacy standards and policies that are at least as secure as ours.

We may also share Personal Information on behalf of the School if instructed or authorized by the School.  Depending on the level of Services that a School has registered for, our Services may allow Schools to use Personal Information to interact with parents, students, teachers, and third-party websites, applications or other web-based services for the benefit of the student or the school system.  Our privacy policy and practices do not apply to any third-party products or services.  Schools are responsible for verifying that adequate privacy protections exist before engaging such third-party websites, application, or other web-based product or service through our Services.   

  1. Data Protection and Security.

EFI uses commercially reasonable physical, technical, and administrative safeguards to preserve the integrity and security of all information collected through our Services. Our Services take reasonable steps to verify your identity before granting you access to your account. However, you are responsible for maintaining the security of your unique password and account information, and for controlling access to your email communications from EFI at all times. EFI cannot ensure or warrant the security of any information you transmit to EFI or guarantee that information we collect may not be accessed, disclosed, altered, or destroyed.  Services are limited to use by Schools located in the United States and information stored in the Services is stored on servers located in the United States.

We encrypt the transmission of Personal Information using secure socket layer technology (SSL). We follow generally accepted standards to protect the Personal Information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. In the event that any Personal Information under our control is compromised as a result of a breach of security, EFI will investigate and, where appropriate, notify those individuals whose information may have been compromised.

  1. Choices About Your Personal Information.

Schools can update account information and customize their Services through their administrator account.  Education Records are managed by the Schools. If you have questions about modifying, reviewing, or deleting Education Records, please contact your School.  Parents can disable their accounts within the School’s account by sending an email to support@educationFramework.com with a request to disable such account, or by sending a request via the ‘help’ function from within the parent’s Education Framework account. 

If a School terminates or otherwise discontinues our Services, EFI will delete all Personal Information within a commercially reasonable time, to be no later than 14 business days after services are discontinued. We may keep De-identified Information. If you have questions about data retentions, please contact us via email or U.S. mail.

  1. Children’s Privacy

We do not collect information from students, including children under 13, without consent.  EFI uses or accesses Education Records only to the extent the School has obtained the appropriate consent and only for the benefit of the student and the School.  If you think that we have inadvertently gathered personally identifiable information from a child under the age of 13 without the proper consent, please contact us at support@educationFramework.com. We reserve the right to verify the complaint but will promptly delete any unauthorized information.  

  1. Links to other Websites or Services.

We do not select, control, or authorize the use of any third-party products or services, including any websites, applications, or web-based services that are linked to or available through our Services.  Schools should always confirm that such third-party product or services have adequate privacy protection policies and practices before utilizing or authorizing their use.

  1. Changes to Our Policy.

We may update or change this privacy policy from time to time and encourage you to periodically review this page for the latest information on our privacy practices. If we are going to make significant changes in the way we use Personal Information, we will give you advance notice of at least 14 days.
